Terms and Conditions with important customer information
Scope
For the business relations between Kakteen-Haage * Blumenstrasse 68 * 99092 Erfurt * Germany and private customers in accordance with §13 BGB, these general terms and conditions apply exclusively. Conflicting or deviating from these terms and conditions Kakteen-Haage does not recognize and hereby expressly disagrees with them. Conflicting terms and conditions of the customer are only valid if Kakteen-Haage expressly and in writing agrees.
Conclusion of the contract:
By clicking on the button "Submit order" you place a binding order of the goods contained in the shopping cart. The confirmation of receipt of the order follows immediately after the order has been sent. The purchase contract is concluded with the delivery of the goods.

Delivery Times
We usually deliver to addresses in Germany within 8 days.
Shortly after the publication of the Kakteen-Haage catalog and in the spring months April to June is high season. Please understand, if the processing of your order takes longer. We always deliver as fast as possible.
In a hurry? Use our 48-hour express service (+ ? 6.00 per order). We ship at the latest two working days after order. (This service is only available within Germany)
Delivery is also possible to a different delivery address. If you would like to have the invoice sent separately by letter, please note this in the comment field to the order (+ 1,00 ?)
Shipments outside the EU require export documents (Phyto certificate, CITES permits, import permit, customs clearance). CITES documents may take a longer application period (6-8 weeks).
Delivery
Our plants are available in limited quantities. We endeavor to keep the data in the online shop as up-to-date as possible, yet it can happen that items that have just been sold out appear in the online shop. Many of our plants come from our own propagation. If a plant is out of stock, we are happy to find an adequate replacement for you. Please note if you do not want a replacement. Please indicate in the comment field when ordering if you have specific replacement requests.
We are entitled to partial deliveries, as far as this is reasonable for you. Additional shipping costs arise only with explicit agreement. In individual cases, items may be sold out that can no longer be replenished. In this case, we only supply the available items, or adequate replacement.

For very large orders, we will inform you about any shipping costs before shipping.
Reorder, changes
We are happy to consider your repeat order or change requests, as long as the order processing has not yet begun. Please keep in mind that changes and requests may delay the delivery.
Withdrawal
As a consumer you are no longer bound to your order within the meaning of § 13 BGB if you withdraw within a period of 2 weeks after receipt of the goods. The period begins at the earliest with receipt of a detailed cancellation policy in text form. The revocation must not contain a reason and can be made in writing (an e-mail to info@kakteen-haage.de) or by returning the goods at our risk. To meet the deadline, the timely dispatch of the declaration of revocation or the goods is sufficient:

Consequences of Withdrawal
In the case of an effective cancellation, the mutually received benefits and any benefits (such as interest) surrendered. If you can not return the service received in whole or in part or only in a deteriorated condition, you may have to pay us compensation for the value. This does not apply if the deterioration of the goods is due exclusively to their examination, as it would have been possible for you in the store, for example. Incidentally, you can avoid the obligation to pay compensation by not using the item as an owner and refraining from anything that affects its value. Parcel shipping items are to be returned at our risk in the original packaging if possible. We take over the costs of the return of goods, if your order exceeds an amount of EUR 40, - for orders below EUR 40, - you pay the return postage. Please frank the package sufficiently, we will refund you the postage amount immediately.
Excluded from the return are:
- Goods that are made to customer specification or clearly tailored to personal needs or
- due to their nature are not suitable for return or spoil quickly
- Software, if the delivered data carriers have been unsealed by you,
- Newspapers, magazines and magazines.
Warranty:
The warranty is provided in accordance with the statutory provisions, whereby, in the event of a defect in the goods, we will at first deliver or repair them at your discretion. If the rectification fails or if the subsequently delivered goods are also defective, you can return the goods for a refund of the full purchase price or keep the goods and reduce the purchase price.
Retention of title
The delivered goods remain our property until full payment.
Jurisdiction
The jurisdiction for all disputes arising from this contract is Erfurt, but not if the customer is a consumer.
